The Federal Mandate: FMVSS 108 Requires Amber
Federal Motor Vehicle Safety Standard No. 108— FMVSS 108, codified at 49 CFR § 571.108 — is the reason every car on the road already has amber lights on it. On the front of a vehicle, white and amber are the only two colors federal law permits for original-equipment lighting: white is reserved for headlamps and daytime running lights, and amber is reserved for signaling and marking the vehicle's outer edges.[1] On the rear, red is required, though amber is also permitted for rear turn signals.[2]

Because this amber is federally mandated, no state can ban it — the question states actually regulate is what happens when a driver or a repair shop wants to add more amber than the factory installed.
Who FMVSS 108 Actually Restricts
FMVSS 108 is a manufacturing and commercial-installation standard, not a driver-facing traffic law. The provision that reaches businesses is the “Make Inoperative” rule at 49 U.S.C. § 30122, which bars manufacturers, dealers, and repair shops from knowingly installing equipment that takes a vehicle's certified lighting out of compliance.[3] It does not, by its text, criminalize a private owner installing parts in their own garage — that individual answers to their state's traffic code instead, which is where amber accessories actually get policed on public roads.
The Impairment Clause: When Aftermarket Amber Becomes Illegal
For amber accessories that aren't explicitly required — auxiliary light bars, fog lights, underglow strips — FMVSS 108's impairment clause governs. Paragraph S6.2.1 prohibits installing any additional lamp that impairs the effectiveness of the lighting the standard does require. 1. Brightness
An auxiliary amber lamp is illegal if it's so intense it “masks” a required lamp — for example, an amber LED strip mounted right next to a factory turn signal, overpowering it so oncoming traffic can't perceive the blink.[5]
2. Color
Even a legal color can impair by placement — a steady amber light mounted at the extreme rear can overwhelm the required red tail lamps a following driver expects to see there.[6]
3. Mounting Location
Amber lights mounted so they interfere with a recognizable lighting pattern — such as the three-lamp identification array on wide trucks — impair a system other drivers rely on to judge vehicle size.
4. Activation Pattern
FMVSS 108 requires nearly all auxiliary lamps to be “steady burning.” A flashing, strobing, or color-cycling amber light — even one triggered by an automated sensor — fails this prong on its own.[7]
NHTSA has applied that fourth prong even to “smart” lighting. One aftermarket product switched a front-mounted LED strip between steady white while accelerating and steady amber while braking, using the vehicle's accelerometer. The device never technically flashed, but regulators warned that overly sensitive rapid switching in stop-and-go traffic would mimic strobing — a reminder that forward-facing signaling has to stay completely unambiguous.[7] The same masking logic governs whether amber rock lights and underglow stay on the right side of the line.
The Science of Amber: SAE J578 Chromaticity
A light isn't legally “amber” just because it looks yellowish. SAE J578, “Chromaticity Requirements for Ground Vehicle Lamps and Lighting Equipment,” defines amber as a precise boundary on the CIE 1931 chromaticity diagram — a mathematical map of every color the human eye can perceive.[8] The boundary keeps amber from drifting toward green (which could read as a traffic signal), toward red (which could be mistaken for a tail lamp), or toward white (which would wash out its visibility in fog or snow).[9]
That precision has teeth with modern LEDs. Manufacturers build amber LEDs three ways: direct-emission (“de-Amber”) chips that emit a narrow, pure amber band; phosphor-converted (“pc-Amber”) LEDs that filter a blue chip through an amber phosphor coating; and filtered-amber, a plain white LED behind an amber-tinted lens. Cheap pc-Amber and filtered-amber products routinely leak too much blue or white light, drifting the output outside SAE J578's boundary and making the part non-compliant as a turn signal or marker lamp even though it visually reads as amber to a shopper.[8]
State Law: Auxiliary and Decorative Amber Lighting
Once an amber accessory clears the federal impairment bar, state traffic codes decide whether a driver can actually switch it on. The pattern repeats across nearly every state: steady-burning amber is fine within specific brightness and mounting limits; flashing amber is not.
Texas
Tex. Transp. Code § 547.305
Texas permits up to two auxiliary driving lamps, mounted 16–42 inches high, emitting white or amber light only. The state caps the total forward lighting output at four lamps exceeding 300 candlepower operating at once — turn on both low beams plus two auxiliary amber fog lights, and the legal maximum is already reached.[10] The same steady-versus-flashing distinction that governs amber fog lights applies here too.
Pennsylvania
67 Pa. Code § 175.66
Pennsylvania allows auxiliary driving and fog lamps in white or amber, spaced at least 20 inches apart, but requires that they wire only to the high beams — they must switch off approaching oncoming traffic. Amber fog lamps may run with the low beams, but only in genuinely adverse weather. Total forward lighting output, headlamps included, is capped at 150,000 candlepower.[11] Pennsylvania is also the state where decorative amber goes furthest out of bounds: § 175.66(h) bans any “ornamental lamp” not installed by the original manufacturer outright, and the state's Superior Court has upheld traffic stops based solely on that statute — illuminated aftermarket wiper nozzles or amber underglow give an officer probable cause the moment they're visible.[12] Amber underglow in Pennsylvania may only be switched on parked on private property or at a static car show, never while driving on a public highway.
LED Light Bars & Pod Lights
It's legal to buy, own, and bolt an amber LED light bar to a personal vehicle. Operating it on a public highway is another matter — light bars aren't DOT-approved auxiliary lamps, their beam pattern lacks the sharp cutoff FMVSS 108 requires to keep light out of an oncoming driver's eyes, and their output easily exceeds state candlepower caps like Texas's. Some states require light bars to be physically covered with an opaque shield while on public roads.
Clear Lenses With Amber Bulbs
Swapping a factory amber turn-signal lens for a clear “Euro” lens over an amber bulb is legal at the federal level as long as the emitted light still meets SAE J578's chromaticity coordinates and delivers the required intensity.[2] The failure point is the passive amber reflex reflector FMVSS 108 requires at the front corners — a clear aftermarket housing that omits it takes the vehicle out of federal compliance and can fail a state safety inspection.
Flashing Amber: The Line Almost No State Crosses
The single most heavily enforced restriction on amber lighting is the near-universal ban on civilians using flashing, strobing, rotating, or oscillating amber lights. A flashing light signals an emergency, a serious hazard, or an active work zone, and every state reserves that signal for authorized vehicles precisely so drivers keep taking it seriously.
The stakes are tied directly to “Move Over” laws, enacted in all 50 states, which require a motorist approaching a vehicle displaying flashing amber warning lights to change lanes away from it or, if that's not possible, slow down substantially.[13] Because a flashing amber light triggers that legal obligation in every other driver on the road, using one without authorization is treated as a serious violation — in several states, on par with impersonating a utility or emergency vehicle.

There is exactly one civilian exception, and it's one every driver already uses: hazard lights. State laws — Pennsylvania's 75 Pa.C.S. § 4305, Ohio's R.C. § 4513.17, and Texas Transp. A candela measures directional intensity — light focused at a specific point — which is why a tow truck working a highway shoulder needs a Class 1 rating: to be seen from 500-plus feet away in bright sunlight, manufacturers use Total Internal Reflection optics that focus the raw LED output into a tight, highly directional beam.[17] A civilian who buys an uncertified flashing amber light online for a personal vehicle isn't just violating state traffic law — the light itself is typically built with a cheaper, wide-angle lens that neither warns approaching drivers effectively nor avoids creating blinding glare, since it was never engineered to either SAE J595 standard.[17]
